Terms and conditions for use

THIS AGREEMENT IS BETWEEN THE EPSRC AND THE ACCEPTER. IT COVERS THE REGISTRATION AND USE OF THE EPSRC WEBSITE COMMUNITIES SYSTEM. IT DOES NOT COVER ANY OTHER EPSRC, OR SUBSIDIARY, SERVICE.

  1. Definitions

    1. We and us refers to the Engineering and Physical Sciences Research Council (EPSRC) and all employees there in.
    2. The accepter, you and your is the person registering and agreeing to our terms and conditions of use.
    3. The system refers to the web management system we use to maintain your data.
    4. The service and tool refers to the EPSRC website communities service.
    5. Your content means all works and materials (including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software and files) that you submit to us or our website for storage or publication on, processing by, or transmission via, our website.
  2. Registration and accounts

    1. You may register for an account with our service by completing the registration form and verifying your request via a link sent to you by email.
    2. If you believe there has been any unauthorised use of your account, you must notify us in writing immediately.
    3. You must not use another person's account to access the service, unless you have that person's express permission to do so.
  3. User IDs and passwords

    1. When you register for an account with our service, you will create a user ID (email address), a display name and password.
    2. Your display name must not be liable to mislead; you must not use your account or display name to impersonate another person.
    3. You must keep your password confidential.
    4. If you believe that your password has been compromised, you must notify us in writing immediately.
    5. Any activity on our service due to failing to keep your password confidential will be your responsibility.
    6. You shall not attempt to obtain, or assist others in obtaining, access to another user's account, unless you have that person's express permission to do so.
  4. Deactivation and deletion of account

    1. At any time we may:
      • deactivate your account;
      • delete your account; and/or
      • edit your account details, without notice or explanation.
    2. You may request that your account and your details are deactivated and / or deleted from the system by emailing or ringing the contact details below.
  5. Your content

    1. You grant to us a, royalty-free licence to use, reproduce, store, adapt, publish, translate and distribute your content in any existing or future media
    2. You grant to us the right to bring an action for infringement of the rights licensed above
    3. You may edit your content to the extent permitted using the editing functionality made available on our website
    4. Without prejudice to our other rights under these terms and conditions, if you breach any provision of these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may delete, unpublish or edit any or all of your content.
    5. You shall not upload, display or transmit any materials through the service and / or the system which are false, offensive, defamatory, threatening, obscene, unlawful, which violate export control laws or which infringe the rights of any other person anywhere in the world.
    6. You shall not knowingly attempt to transmit to or via the service and / or the system any information that contains a virus, worm, Trojan horse or other harmful or disruptive component.
  6. Intellectual property

    1. EPSRC owns or is licensed to use all intellectual property rights in the service.
    2. You acknowledge that under these terms of use you do not acquire ownership of any intellectual property rights of whatever nature in and relating to the service.
  7. Our content

    1. You are permitted to access content through the service solely for the purpose of reviewing information relating to your Organisation, to the extent permitted by the EPSRC.
  8. Information we collect

    1. We ask for your personal details to be able to effectively communicate with you as an individual and give the personal touch in doing so. The kind of information we collect is:
      • Title (optional)
      • Name (first and last) (required)
      • Telephone number (optional)
      • Email address (required)
      • Organisation (required)
      • Job title (optional)
      • Display name (required)
      • Password (required)
      • Security questions and answers (required)
      • Interests / subscriptions (optional)
      • Profile (optional)
      • Image / avatar (optional)
  9. How we use this information

    1. Your display name will be used in the future for blog posts and comments instead of displaying contact information - see below in future updates section.
    2. Your password is personal to you, and only you will have access to this. We will store this securely within our system and this can be reset using the security questions and answers you choose.
    3. Your image / avatar will be used for your profile for networking as well as the comments and blogs functions which will be introduced later - see below in future updates section.
    4. Any of your details may be used for analytical purposes, such as seeing how many users are registered from a particular organisation; or potentially contacting you regarding the use of this service or your interaction with us.
    5. We reserve the right to make edits or remove any information if it is deemed offensive or inappropriate.
  10. Third party access to information

    1. No information you submit will be accessible by third parties. It will only be accessible by EPSRC employees. We may release statistical information to third parties, however, this will not present any identifiable information and will be anonymised.
    2. The information you provide in your profile may be accessed by other system users with your consent.
  11. Future updates

    1. We will highlight any changes to these terms and conditions of use within your user area dashboard and email you with the updates when appropriate. If you subsequently do not agree to any new condition you will be able to request that your details and account are deleted from the system by emailing or ringing the contact details below.
    2. We will be developing the system further to incorporate more advanced dashboard functions to increase your user experience and possibly adding networking functions to allow you to discuss ideas, issues or solutions as well as helping to bridge the gap between organisations and breaking down the barriers of locality.
    3. We will also be adding new functions to the system for users to contribute to the site via comments and blogs (where appropriate).
  12. Personal data

    1. All personal data collected by EPSRC will be processed in accordance with the Data Protection Act 1998, and may be held on computerised databases and / or manual files. The information provided will be viewed by EPSRC staff only and your information will not be used for any other purpose without your specific consent.

  13. Exclusions and Limitations of Liability

    1. Owing to the nature of the Internet there is no guarantee that this system and / or service will always be available to users. You should ensure that you have appropriate protection against viruses and other security arrangements in place whilst using the Internet.
    2. The service and any information or other material contained in it are made available strictly on the basis that you accept it on an "as is" and "as available" basis. Where you rely on any information or other material contained in it, you do so entirely at your own risk and you accept that all warranties, conditions and undertakings, express or implied, whether by common law, statute, trade usage, course of dealings or otherwise in respect of this system and the service are excluded by EPSRC to the fullest extent permitted by law. WITHOUT LIMITATION TO THE FOREGOING, NO WARRANTY IS GIVEN THAT THE SERVICE OR SYSTEM WILL BE FREE FROM VIRUSES, TROJAN HORSES, BUGS, OMISSIONS OR ERRORS, OR THAT DEFICIENCIES OR DEFECTS IN THE SERVICE OR SYSTEM WILL BE CORRECTED.
    3. EPSRC excludes all liability whatever, to the fullest extent permitted by law, in respect of any loss or damage resulting or arising from any non-availability or use of this system or of the service, or from reliance on the contents of this system or service or any material or content accessed through this system or service.
  14. Law and jurisdiction

    1. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law. Any dispute or claim arising out of the accessing or use of this service or arising out of or in connection with these terms of use or their subject matter or formation (including non-contractual disputes or claims) shall be subject to the jurisdiction of the English courts.
