Appeal against non-disclosure under the Freedom of Information Act

If you have requested information from us and are not satisfied that we have complied with the Freedom of Information Act 2000 in our response, you have the right to appeal.

1 - Making an appeal

Please write to our Director of Communications & Information:

Our Director of Communications & Information will formally investigate the matter. If it is obviously the most appropriate action to take, our Records & Information Compliance Manager will sometimes pass an appeal straight to the Director of Communications & Information. We will write to let you know if this is the case.

After investigating your complaint, our Director of Communications & Information will write to you with a response. The result of this could be:

  • Release of all information previously withheld
  • Release of some of the information previously withheld
  • Confirmation of the original decision to withhold information.

In all cases where information has been withheld against a qualified exemption, a further public interest test will be applied.

2 - Appeal to the Information Commissioner

If you are not satisfied with the response from our Director of Communications & Information, you can appeal to the Information Commissioner. Information about this is included in the letter from the Director of Communications & Information.
